Luxury Restaurant Guide Membership Terms & Conditions

1. About Us

1.1 Company Information

Luxury Restaurant Guide (“LRG”, “we”, “us”, “our”) is owned and operated by Vision Marketing Limited, a company registered in England and Wales under company number 03749057.

1.2 Agreement

These Terms and Conditions govern your purchase and use of membership with Luxury Restaurant Guide.

By purchasing, renewing or using a membership, you agree to be bound by:

  • these Terms and Conditions;
  • our Privacy Policy;
  • our Cookie Policy; and
  • any additional membership-specific terms presented at the point of purchase.

If you do not agree to these Terms, you should not purchase or use a membership.

1.3 Consumer Memberships

Memberships are intended for private consumers and are not designed for commercial or business use unless expressly agreed in writing.

1.4 Changes to these Terms

We may amend these Terms from time to time to reflect changes in law, regulation, business practices, technology, membership benefits or operational requirements.

Any material changes that affect existing memberships will be updated on our website or app. Members should therefore review these Terms and Conditions prior to renewal.


2. Membership Eligibility and Registration

2.1 Eligibility

You must be at least 18 years of age to purchase or hold a membership.

2.2 Accurate Information

You agree to provide accurate, complete and current information when applying for membership and to keep your details updated throughout your membership.

This includes:

  • email address;
  • postal address;
  • telephone number; and
  • payment details where applicable.

We are not responsible for missed communications resulting from inaccurate information.

2.3 Membership Categories

Memberships may include:

  • Luxury Restaurant Club Membership;
  • Associated Partner Hotel Memberships; and
  • any promotional or partner memberships offered from time to time.

Associated Partner Hotel Memberships may include selected participating hotel groups and hospitality partners as determined by LRG.

2.4 Membership Is Personal

Membership is personal to the named member and may not be:

  • transferred;
  • shared;
  • lent;
  • sold; or
  • assigned

without our prior written consent.


3. Membership Types and Access

3.1 Digital Memberships

Digital memberships are accessed through the LRG mobile application.

Your membership will commence once payment has been accepted and your account activated.

You are responsible for maintaining the confidentiality of your login credentials and for all activity conducted through your account.

3.2 Printed Memberships

Where a printed membership package is selected, we will dispatch your membership materials to the postal address supplied during registration.

You should notify us within 30 days if your package is not received.

Replacement membership packs requested after this period may be subject to an administration fee of up to £30.

Replacement memberships retain the original expiry date.

3.3 Membership Cards Digital and printed membership cards remain the property of LRG and may be withdrawn or deactivated at any time where membership ends or is suspended.


4. Membership Term and Renewal

4.1 Membership Period

Memberships may be offered as:

  • monthly subscriptions;
  • annual subscriptions; or
  • fixed-term promotional memberships.

Minimum membership periods are:

  • one month for monthly subscriptions; and
  • twelve months for annual memberships.

4.2 Membership Expiry

Membership expiry dates are displayed:

  • within your online account;
  • within the LRG app; and/or
  • on your printed membership card.

4.3 Automatic Renewal

Certain memberships operate on an automatic renewal basis.

Where auto-renewal applies, your membership will automatically renew at the end of each membership period unless cancelled in accordance with Section 6.

By purchasing an auto-renewing membership, you authorise us to collect future subscription fees using your chosen payment method.

4.4 Renewal Reminders

Where required by law or where we choose to do so, renewal reminders will be sent to the email address registered on your account. Failure to receive or read a reminder email shall not invalidate an otherwise valid renewal.

4.5 Promotional Memberships

Memberships issued through promotional partners, complimentary offers or free trial arrangements may not automatically renew unless expressly stated at the time of registration.

4.6 Telephone Purchases

Memberships purchased by telephone will not automatically renew unless you have expressly agreed to an ongoing subscription arrangement.


5. Membership Fees and Payment

5.1 Membership Fees

Current membership fees are displayed on our website and at the point of purchase.

We reserve the right to amend membership fees from time to time.

Where your membership is subject to automatic renewal, we will provide notice of any material fee increase before the renewal is processed.

5.2 Payment Authorisation

By providing payment details, you confirm that you are authorised to use the payment method submitted.

5.3 Failed Payments

If a payment cannot be processed, we may:

  • attempt to take payment again;
  • request updated payment information;
  • suspend access to membership benefits; or
  • terminate your membership.

5.4 Outstanding Amounts

You remain responsible for any outstanding fees due under your membership agreement.

5.5 Reinstatement

Memberships suspended due to failed payments may be reinstated at our discretion once all outstanding amounts have been settled.

5.6 Updating Payment Information

If you wish to change your existing payment method, you will need to contact admin@luxuryrestaurantguide.com or 01276 850881 before payment is due.


6. Cancellation and Consumer Rights

6.1 Your Right to Cancel

If you purchase membership online, by telephone or through another distance-selling method, you may cancel within 14 days of purchase under the Consumer Contracts Regulations 2013.

6.2 Use During Cooling-Off Period

Where you request immediate access to digital membership benefits during the cooling-off period, you acknowledge that use of those benefits may affect your entitlement to a full refund.

6.3 Membership Reewals

Any statutory cooling-off period (14 days) does not apply to subsequent renewals.

6.4 Printed Membership Returns

Where printed materials have been supplied, we may require their return before any refund is processed where permitted by law.

6.5 Cancelling Auto-Renewal

You may cancel an auto-renewing membership at any time by providing at least 24 hours’ notice before the next renewal date.

Your membership will remain active until the end of the current paid period.

7. Lost or Stolen Membership Cards

Lost or stolen printed membership cards must be reported immediately.

A replacement fee of up to £15 may apply.

We are unable to replace lost vouchers or promotional inserts included within membership packs.


8. Membership Benefits

8.1 Participating Venues

Membership provides access to discounts, privileges, rewards, complimentary offers and benefits made available by participating hospitality providers.

8.2 Benefit Availability

Benefits may vary between participating venues and are subject to availability, restrictions and exclusions.

Members should check the website, app or venue directly before booking.

8.3 Exclusion Dates

Benefits are generally unavailable on:

  • Valentine’s Day;
  • Mother’s Day;
  • Christmas Day;
  • Boxing Day;
  • New Year’s Eve;

and may be unavailable during special events, promotional periods or other excluded meal periods or dates specified by participating venues.

8.4 One Membership Per Booking

Only one membership benefit may be used per table, reservation or booking unless otherwise stated.

Benefits cannot be used in conjunction with any other offer.

8.5 Proof of Membership

Members must quote their membership number when requested and present a valid digital or printed membership card when redeeming benefits.

8.6 Complimentary Dining Offers

Where complimentary dining is offered, the complimentary element shall be calculated by dividing the qualifying food bill between the number of diners in the party and subtracting one portion for the member.

Drinks, service charges and excluded items are not included in the calculation.

8.7 Changes to Benefits

We reserve the right to amend, replace, withdraw or introduce membership benefits at any time.


9. Partner Venue Participation

9.1 Independent Businesses

Participating restaurants, hotels and hospitality providers operate independently from Luxury Restaurant Guide.

9.2 Venue Changes

Participating venues may:

  • join;
  • leave;
  • suspend participation;
  • amend benefits;
  • alter opening times;
  • withdraw offers; or
  • change booking conditions

at any time without notice.

9.3 No Guarantee

We do not guarantee:

  • continued participation of any venue;
  • a minimum number of participating venues;
  • availability within any geographic area; or
  • availability of any specific benefit.

Changes to participating venues do not automatically give rise to refund rights.

9.4 Venue Terms

Participating venues may operate their own policies regarding:

  • bookings;
  • cancellations;
  • deposits;
  • dress codes;
  • minimum spends; and
  • eligibility requirements.

Members are responsible for checking venue-specific conditions before booking.


10. Privacy and Personal Information

We process personal information in accordance with applicable data protection legislation, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

Full details of how we collect, use, store and protect personal information are contained in our Privacy Policy.

By joining LRG, you acknowledge that your personal information will be processed in accordance with that Privacy Policy.


11. Service and Marketing Communications

11.1 Service Communications

We may send communications necessary to administer your membership, including:

  • payment confirmations;
  • renewal reminders;
  • membership notices;
  • service announcements;
  • security notifications; and
  • updates to these Terms.

These communications form part of the membership service.

11.2 Marketing Communications

Where permitted by law, we may send information regarding:

  • new membership benefits;
  • hospitality offers;
  • partner promotions;
  • events;
  • competitions; and
  • other relevant opportunities.

You may opt out of marketing communications at any time.


12. Fraudulent Use and Misuse

12.1 Prohibited Activities

Members must not:

  • share membership credentials;
  • permit another person to use their membership;
  • reproduce membership cards;
  • provide false information;
  • misuse benefits; or
  • attempt to circumvent membership restrictions.

12.2 Investigations

We reserve the right to investigate suspected misuse or fraudulent activity.

12.3 Consequences

Where misuse or fraud is identified, we may:

  • suspend membership;
  • terminate membership;
  • refuse future applications;
  • recover improperly obtained benefits; and/or
  • take further legal action where appropriate.

No refund will be provided where membership is terminated due to fraud or serious breach of these Terms.


13. Liability and Disclaimer

13.1 Information Accuracy

We use reasonable endeavours to keep information on our website and app accurate and up to date.

However, venue information is supplied by third parties and may change without notice.

13.2 Third-Party Services

Any contract for food, accommodation, hospitality services or other services is between you and the participating venue.

We are not responsible for:

  • quality of service;
  • pricing;
  • availability;
  • cancellations;
  • venue conduct; or
  • disputes between members and venues.

13.3 No Warranty

We do not provide warranties regarding services supplied by third parties.

13.4 Website and App Availability

We do not guarantee uninterrupted access to our website, app or membership services.

13.5 Maximum Liability

To the fullest extent permitted by law, our total liability arising from membership shall not exceed the amount paid by you for the current membership term.

13.6 Nothing Excluded

Nothing in these Terms excludes or limits liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation; or
  • any liability that cannot legally be excluded.

14. Events Outside Our Reasonable Control

We shall not be liable for delays or failures in performance caused by events beyond our reasonable control, including:

  • natural disasters;
  • acts of government;
  • pandemics;
  • cyber-attacks;
  • telecommunications failures;
  • utility outages;
  • labour disputes;
  • supplier failures; or
  • other force majeure events.

15. Suspension and Termination

We may suspend or terminate membership where:

  • these Terms are breached;
  • payment cannot be collected;
  • information supplied cannot be verified;
  • fraudulent activity is suspected; or
  • conduct may damage our reputation or relationships with participating partners.

Membership terminated under this section may be refused future membership applications.


16. Intellectual Property

All content available through LRG, including website content, app content, membership materials, logos, trademarks and promotional materials, belongs to LRG or its licensors.

No content may be copied, reproduced, distributed or commercially exploited without our prior written consent.


17. Electronic Communications

You agree that we may communicate with you electronically regarding your membership.

Any notice sent to the email address associated with your account shall be deemed received at the time of transmission unless delivery failure notifications are received.

You are responsible for maintaining a valid email address.


18. Complaints

We will endeavour to investigate and resolve complaints fairly and promptly.


19. General

These Terms, together with our Privacy Policy and Cookie Policy, represent the entire agreement between you and us concerning your membership.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Any failure to enforce a right under these Terms shall not constitute a waiver of that right.

We may transfer our rights and obligations under these Terms to another organisation, provided that doing so does not adversely affect your rights.


20. Governing Law

These Terms are governed by the laws of England and Wales. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.


21. Mobile Application and App Store Terms

21.1 App Providers

These Terms are concluded between you and Luxury Restaurant Guide only.

Apple Inc. and Google LLC are not parties to these Terms and are not responsible for the App or its content.

21.2 Licence

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable and revocable licence to use the App for your personal use.

21.3 App Store Rules

If the App is obtained through Apple’s App Store, your use must comply with Apple’s App Store Terms and Usage Rules.

21.4 Support and Maintenance

Luxury Restaurant Guide is solely responsible for support, maintenance and updates relating to the App.

Apple and Google have no support obligations whatsoever.

21.5 Warranty Disclaimer

The App is provided on an “as is” and “as available” basis.

We do not guarantee uninterrupted operation, error-free functionality or compatibility with every device or operating system.

21.6 Product Claims

Luxury Restaurant Guide, and not Apple or Google, is solely responsible for any claims relating to:

  • product liability;
  • consumer rights;
  • privacy;
  • intellectual property; or
  • App performance.

21.7 Intellectual Property Claims

In the event of any third-party claim that the App infringes intellectual property rights, Luxury Restaurant Guide shall be solely responsible for investigating, defending and resolving such claim.

21.8 Legal Compliance

You represent that:

  • you are not located in any territory subject to applicable sanctions or trade restrictions prohibiting use of the App; and
  • your use complies with applicable laws and regulations.

21.9 Third-Party Beneficiary Rights

Where the App is downloaded through Apple’s App Store, Apple and its subsidiaries shall be third-party beneficiaries of these Terms and may enforce those provisions applicable to Apple.

21.10 Mobile Network Charges

You are responsible for any mobile data, roaming or network charges incurred through use of the App.

21.11 App Updates and Availability

We reserve the right to update, modify, suspend or withdraw the App or any functionality at any time.

We shall not be liable where your device ceases to meet technical requirements necessary for continued use of the App.
